Please read the following Terms and Conditions carefully. The purchase and/or use of our any of any product offered on metrotemplate.com implies that you have read and accepted the following Terms and Conditions:

LICENSING

Upon purchasing your free template, you will be granted a One-Time Single-Usage License. This license entitles you to use each individual free template for a single website only, belonging to either yourself or your clients. You must purchase the same free template again in order to obtain another One-Time Single-Usage License if you choose to use the same free template in connection with any additional websites or projects.

ARTWORK, FONTS, AND IMAGES

All images, pictures, clipart, photos, and fonts utilized in our freetemplates are royalty-free. One-Time Single-Usage Licenses give you the right to utilize these components as a part of the website you produce with your free template. You can only use these images, pictures, clipart, photos, and fonts to produce one website only. Any and all separate utilization or distribution of these items is strictly prohibited. All images and illustrations used in templates come in a flattened single-layer, as is. Layered files will not be made available with the purchase of your template.
Many of the free templates that use Flash technology contain effects produced with Adobe After Effects and/or 3DMax. To find out whether such effects are included in specific free templates, please contact our Support Team via E-mail.
Please be aware that in order to edit these components, you will need software capable of working with these files, as well as the skills to utilize the software in order to produce the desired effects. You may of course choose to pay a 3^rd party to complete such work on your behalf. We strongly recommend contacting IconWebsiteDesign.com for this purpose, in order to have any installation or customization completed at an additional cost to be agreed upon between you and IconWebsiteDesign.com.

CHANGES & MODIFICATIONS TO FREE TEMPLATES

You are authorized to make necessary changes and/or modification to our free templates in compliance with the One-Time Single-Usage License.

UNAUTHORIZED USAGE & UTILIZATION

In accordance with the nature of our One-Time Single-Usage license, you shall not place any of our templates, in their original state, in a modified state, or in any other state, on a diskette, CD, DVD flash drive, website, server, or any other medium for the purpose of transferring templates purchased from our website, or components thereof, to any other persons or entities. You shall not offer them in any way for distribution or sale without receiving explicit written consent from MetroTemplate.

ASSIGNABILITY

You shall not sub-license, assign, or transfer any of our templates, or components thereof, to any entity, without prior written consent and approval from MetroTemplate.

REFUNDS

As we are selling non-tangible, irrevocable goods we do not issue refunds after the product has been made available to you, the end consumer. MetroTemplate may choose to make exceptions to this specific rule if and when it appears that a product sold was in fact not-as-described. This decision will be made on a case-by-case basis at MetroTemplate’s sole discretion. The deadline for any refund request is two weeks after the purchase and/or delivery date, whichever is last. MetroTemplate may require the submission of a waiver, acknowledging that you will not have rights to utilize the intellectual property which you are requesting a refund on, namely the template, and any of its components as described in these Terms and Conditions.

OWNERSHIP

You do not claim intellectual property right or exclusive ownership to any of our products, modified or unmodified. All products are property of independent content providers. Our products are provided "as is" without warranty of any kind, either expressed or implied. In no event shall our company or its agents be liable for any damages including, but not limited to, direct, indirect, special, punitive, incidental or consequential, or other losses arising out of the use of or inability to use our products.

INSTALLATIONS

We do not install any of our free templates. We recommend contacting IconWebsiteDesign.com for installation and customization services, as well as website hosting and internet marketing services, at an additional cost to be negotiated with IconWebsiteDesign.com.

ANTI-FRAUD CHECK

Purchased may be paused for a manual anti-fraud check. Anti-fraud checks are conducted to protect consumers in the case that someone other than the actual credit card holder in question is trying to make a purchase using an a credit card account with permission or authorization to do so. In many cases, this may be the direct result of identity theft, and it is our goal to stop such transactions when possible.

THIRD-PARTIES SERVICES

We may recommend or otherwise make mention of third parties on our website. As there are services that MetroTemplate does not offer, which you may benefit from, we wish you to be aware of your opportunity to purchase these additional services elsewhere. We do not, however, exude any control whatsoever over these third parties or their services. MetroTemplate assumes no role in any agreements that you may make with said third parties. In purchasing your template from MetroTemplate, you agree that we will not be held liable in any way in regards to your usage of such third party goods and services. These third parties may have their own respective terms of use and other rules and regulations. When utilizing our intellectual property, namely our free templates, you agree to comply with such terms and policies of third parties as well, should you choose to do business with them. If any such terms or policies conflict with our terms, agreements or policies, you must comply with those of MetroTemplate.

GOVERNING LAWS AND JURISDICTIONS

By accessing this website, you agree that all issues related to your access to and utilization of this website and/or its products shall be governed by the statutes and laws of the State of Florida, without regard to the conflict of laws principles thereof. The parties specifically disclaim the U.N. Convention on Contracts for the International Sale of Goods. You also agree and hereby submit to the exclusive personal jurisdiction and venue of the state and federal courts of Broward County, Florida with respect to any such matters relating to your access or use of this website and/or its products.

DISCLOSURE OF INFORMATION

You may not disclose any order information including, but not limited to, Order ID, download link, etc. to any other parties whatsoever.
